Elon Musk’s X Challenges New York’s Transparency Act

Elon Musk has filed a federal lawsuit in Manhattan’s federal court, challenging New York State’s new content transparency law. The New York Content Transparency Law, which is officially titled as Stop Hiding Hate Act mandates social media companies to publicly disclose their methods for moderating hate speech, harassment, and misinformation. The law was enacted in December 2024.

In the lawsuit, Elon Musk has argued that it’s a legal battle over First Amendment rights, as the Content Transparency Law infringes on editorial freedoms.

X(formerly Twitter) executive Elon Musk had acquired the microblogging platform in October 2022.

While talking about her stance on the Law, New York Governor Kathy Hochul has reportedly stated, “We are taking bold action to hold companies accountable, strengthen protections, and give consumers the transparency and security they need and deserve.”

Elon Musk has further argued that similar legal challenges are observed in other states, raising concerns about the role of government oversight in platform governance and the balance between digital accountability and free expression.

The US Content Transparency Act is not the first of its kind. In the EU, the Digital Service Act is used to moderate content and remove hate speech on social media platforms. This particular Transparency Act highlights a gap between regulation and the evolving dynamics of online media, as harmful content no longer spreads linearly. Institutions and policymakers are now expected to respond to compliance and reputational risks as soon as they emerge.
